Visa Overstay and Illegal Reentry

  • Visa Overstay

    • Definition: A visa overstay occurs when an individual remains in the United States beyond the expiration date of their authorized stay, violating immigration law.

    • Penalties:

      • Individuals who overstay their visa may face deportation, a ban on re-entry for up to 10 years, and possible difficulties in obtaining future visas or entry to the U.S.

      • If overstayed by more than 180 days but less than one year, a 3-year bar on re-entry is imposed. If over one year, a 10-year bar applies.

  • Illegal Reentry After Deportation

    • Definition: Illegal reentry is the act of re-entering the United States after being deported or removed.

    • Penalties:

      • Reentry without proper authorization is a federal crime, punishable by up to 2 years in prison for the first offense and up to 20 years for subsequent offenses, depending on the circumstances.

      • Fines may also be imposed, and the individual may be deported again upon completion of any sentence.

Family Petition

  • Reuniting families is a cornerstone of U.S. immigration policy. As a U.S. citizen or lawful permanent resident (green card holder), you have the opportunity to sponsor certain family members for lawful status in the United States.

  • At Ruben Restrepo Law, we are committed to guiding families through the intricate petition process, ensuring that all required forms and documentation are accurately completed and submitted to prevent unnecessary delays. Whether you are seeking to petition for a spouse, child, parent, or sibling, our experienced team will help you understand eligibility requirements, priority categories, and anticipated timelines.

  • Family-based immigration cases often necessitate robust supporting evidence to establish the legitimacy of relationships. We collaborate closely with our clients to compile the necessary documentation and promptly address any USCIS requests for additional evidence.

Deportation and Immigration Violations

  • Deportation

    • Definition: Deportation is the formal removal of an individual from the United States due to violations of immigration laws.

    • Penalties:

      • Deportation can result in a permanent ban from re-entering the U.S., depending on the offense, and the individual may face additional legal challenges to re-enter the country.

      • Those deported may also be subject to detention or arrest by immigration authorities in certain cases.

  • Immigration Violations (e.g., Entry Without Inspection)

    • Definition: Immigration violations include illegal entry into the U.S. without inspection or failing to comply with immigration laws.

    • Penalties:

      • Those caught entering without inspection can face fines, detention, and deportation.

      • Individuals may also be barred from re-entering the U.S. for several years depending on the specifics of their violation (e.g., 5, 10, or 20 years).
